The client making the booking warrants that they have the full authority to accept these Terms and Conditions on behalf of all participants in their party and assumes full responsibility for ensuring that all members of the party comply with the Terms and Conditions, safety instructions, and operational requirements of Madeira Geo Tours.
Both Madeira Geo Tours and the client shall act in good faith and demonstrate mutual cooperation throughout the duration of the booked arrangements, particularly in matters related to safety, communication, compliance with requirements, timeliness, and financial settlement. Any breach of this duty of good faith or cooperation shall constitute a material breach of these Terms and Conditions, potentially leading to the immediate termination of the service.
Should any disagreement or dispute arise, the matter shall be governed by Portuguese law. The parties agree that the competent and exclusive jurisdiction for settlement shall be the Courts of Funchal, Madeira, Portugal.
If any provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, which shall not affect the validity and enforceability of any other remaining provisions.
Madeira Geo Tours reserves the right to change, amend, or modify these Terms and Conditions at any time. The updated Terms and Conditions will be effective immediately upon posting on the Madeira Geo Tours website. The client is responsible for regularly reviewing the Terms and Conditions.
